Short Term Rental Permit Application

NOTE: Effective 6/17/2021, this application form may only be used to file short term rental registration applications if the host intends to pay by cash or check at City Hall. To file your registration and make payments online, visit the Host Compliance registration portal.

Short term rentals (STRs) are defined in Ch. 17.35 of the BMC as rentals of residential homes for less than 30 consecutive days. Before you can host STRs in your home in Brisbane, you must first apply for and receive a Short Term Rental Permit. Make sure you completely fill out the application form below and upload all required supporting documentation where indicated. Missing information will delay review of your permit application.

Can I Host an STR? 

You can apply to host an STR in Brisbane if you meet the following criteria:

  • You own the home you want to rent as an STR
  • The home you want to rent as an STR is your permanent residence, meaning you reside there for at least 275 days out of the year
  • The home you want to rent as an STR is a single-family home, not a multi-family home/apartment or an accessory dwelling unit/granny unit/secondary dwelling unit
  •  You will be present on the property during the rental period; unhosted "whole home" rentals are not permitted.

What Documents Do I Need?

Before you apply, make sure you have the following documentation in a digital format to upload with your application:

  • Proof of homeownership
  • Proof of permanent residency in the home
  • Proof of insurance
  • Floor plan showing the rooms to be rented within the home
  • Site plan showing required parking on the property

You will also need to pay an application fee in the amount of $323 after your application has been accepted for processing. Fees may be paid over the phone by Visa or MasterCard (2% fee applies) or by check.

Short term rentals are only allowed in single-family homes.

A host must be the homeowner.

The home must be the host's permanent residence.

You must have short term rental liability insurance providing at least $500,000 of coverage.

Only one document is required to provide evidence of your homeownership. This could be a copy of your property tax bill, documentation of your homeowner's income tax exemption, or a copy of a title report or deed showing title vested in your name.

You must upload at least three documents that show you live in the home as your full-time residence. Acceptable documents include a driver's license, vehicle registration certificate, State or Federal tax return statement (you may redact your social security number), bank or credit card statement, or utility bill (water, power, internet, cable/satellite).

Hosts must have short term rental liability insurance with coverage of at least $500,000.

Provide your insurance policy document that clearly show the address of the insured property, your name, the policy description verifying it is for short term rental activity, and the coverage amount of at least $500,000.

Number of habitable rooms you will offer for short term rental occupancy: *
A habitable room includes a bedroom, and any other room intended for guests to occupy (like a living room or office with a sofa bed or futon). The City's regulations allow no more than two habitable rooms to be offered for short term rentals.
Upload a floor plan showing where the rooms you want to rent will be located within the home and how they will be accessed from the street. The plan does not have to be to scale and may be hand drawn, but does need to be legible. Each room must be labeled (e.g., kitchen, hallway, bedroom). The rooms to be rented as short term rentals must be clearly labeled as such.

The City's regulations require that there is at least one parking space on the property for every habitable room you offer for short term rental. For example, if you will be offering a bedroom and a living room with a pullout couch for short term rental, that would count as two habitable rooms and you would need to have at least two parking spaces on the property. Parking spaces must be on the property in a driveway, parking deck or other paved parking area, or in a garage or carport. Street parking spaces in the street in front of your home will not count toward the parking requirement. Before the City can issue a short term rental permit, City staff will inspect the property to make sure that the parking spaces identified in your application are usable for parking.

Upload a site plan that shows the property lines, the location of the home on the property, and the location and number of on-site parking spaces. The site plan does not need to be to scale and may be hand drawn, but it must be legible and labeled for clarity.
