AB 2234 Postentitlement Phase Permits
In accordance with Assembly Bill (AB) 2234, the following information is provided for transparency for residential development postentitlement processing. AB 2234 does not apply to nonresidential development.
What is a Postentitlement Phase Permit:
A “postentitlement phase permit” includes all non-discretionary permits required after the entitlement phase, or discretionary approvals, have been completed. A postentitlement phase permit includes, but is not limited to, all of the following:
- Building permits (for demolition, construction, off-site improvements, etc.)
- Encroachment permits
- Grading permits
A postentitlement phase permit does not include a permit required and issued by a special district, a utility that is not owned and operated by a local agency, or any other entity that is not a city or county.
